The contest Earn a chance to win your purchase; Register your warranty is organized by Bains Ultra inc. (BainUltra). The contest takes place across Canada (including the province of Québec), in the United States and Mexico between January 1st, 2012 at 12:00 am EST and December 31st , 2012 at 11:59 pm EST (contest term). You are eligible to win your purchase from an authorized BainUItra dealer of any BainUltra product according to the admissibility conditions.

Admissibility conditions

To be admissible, you must be eighteen (18) years old or over and have purchased, from an authorized BainUItra dealer, a BainUltra soaker tub, ThermoMasseur®, Vedana® or Temazkal® and have registered your warranty during the contest dates.

You are not admissible, if, at any moment during the contest term, you are (or are residing with) a BainUltra employee, agent, administrator or representative.

Participation

The contest begins January 1st, 2012 at 12:00 am EST and ends December 31st, 2012 at 11:59 pm EST. To participate, you must fill out your warranty registration form on-line at www.bainultra.com/warranty and click on Warranty registration to enter your information. You can also mail your completed registration form to BainUltra, 956 chemin Olivier, St-Nicolas, Québec, Canada G7A 2N1. Photocopies, faxes and handmade duplicates are accepted if they contain exactly the same information as the original warranty registration form.

To participate without purchase you may write your full name, address and telephone number on a sheet of paper and include an original hand written 50 word essay, titled: ‘’Why I would love to own a BainUltra product’’. Participation request must be mailed to BainUltra, 956 chemin Olivier, St-Nicolas, Québec, Canada G7A 2N1.

All entries and participation requests must be received by BainUltra, electronically or postmarked, within the above-stated time frame to be admissible.

Maximum one (1) entry per eligible BainUltra unit purchased and one (1) participation request by homeowner. Should a homeowner purchase more than one (1) BainUltra soaker tub, Thermomasseur®, Vedana® or Temazkal® from an authorized dealer, each unit purchased may be entered once into the contest. Each unit must be on a separate warranty registration form.

Prize description

The winner will receive the complete reimbursement by check of the cost of their BainUltra soaker tub, ThermoMasseur®, Vedana® or Temazkal®, excluding taxes, installation or shipping fees as stated on their invoice, which must be provided by the winner to redeem their prize. The winner participating without purchase would be entitled to five hundred dollars ($500). The prize is paid in the currency of the winner’s residence if the case of a non-purchase participation.

Prize awarding method

The draw valued between five hundred dollars ($500) and ten thousand dollars ($10,000) will take place among the eligible participants on January 15th 2013 at 14:00 EST. The randomly selected participant will be declared winner providing they fulfill all the rule admissibility conditions and participation requirements.

The winner agrees to release and hold harmless BainUltra, its subsidiary, promotional agency, partners, employees, agents and authorized dealers from and against any damages arising out of the receipt or use of their prize. The person whose name is drawn as being the winner will have to sign, before obtaining their prize, a Declaration and an exemption of responsibility form.

Should the person whose name is drawn reside in Québec, this person will be required to answer, in a stipulated time frame, a skill-testing question included in the Declaration and an exemption of responsibility form.

The winner will be contacted by phone during the week following the draw. This person will have to claim their prize within a fourteen (14) day period and complete and return the Declaration and an exemption of responsibility form within the same time frame to BainUltra, 956 chemin Olivier, St-Nicolas, Québec, Canada G7A 2N1. If the prize is not claimed within this time period, or if the winner cannot be reached within fourteen (14) calendar days, a new draw will take place until a winner is confirmed. BainUltra will mail the prize to an address in Canada, the United States or Mexico using the means deemed appropriate by the contest administrator.

General rules

By participating in the contest, the winner authorizes BainUltra and its representative to use, if requested, without additional compensation his or her name, likeness, photograph, declaration pertaining to the prize and place of residence (town only) and/or his or her voice for promotion or advertising regarding the contest exclusively.

The prize must be accepted as is and cannot be transferred. No substitution allowed.

The refusal of the prize by the winner frees BainUltra from all responsibilities and obligations toward the winner.

Any falsification of information or documentation on the part of the participant will automatically disqualify them from the contest. BainUltra’s decision is final and without appeal.

BainUltra assumes no responsibility resulting from:
a) loss, delay, address mistakes on mail or e-mail, technical, communication or computational malfunctions, software or material breakage, fraudulent calls or any other errors or malfunctions related to the administration of the contest;
b) loss or theft or misuse of the prize.

In the province of Québec, any litigation in respect to the conduct or organization of a contest may be submitted to the Régie des alcools, des courses et des jeux (Québec’s Alcohol, Races & Gaming Board ) for a ruling. Any litigation in respect to the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

BainUltra reserves, at its entire discretion, the right to cancel or suspend this contest if it becomes technically corrupted (computer virus or bug) or by any non-authorized human intervention or for any other cause out of BainUltra’s control that could corrupt the contest administration, security, impartiality or procedure, subject to, in the Province of Québec, the Régie des alcools, des courses et des jeux (Québec’s Alcohol, Races & Gaming Board )’s approval.

Participation implies the agreement to the above-stated contest rules.

All decisions are irrevocable.
